Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the MiluTV mobile and TV application (the "App") published by Jérôme Monsellier, sole proprietor trading as Monselio, registered in France under SIREN 501 159 891, with its business address at 266C impasse des Tournesols, 30000 Nîmes, France ("Monselio", "we", "us", "our"). By downloading, installing, or using the App, you ("you", "the user") agree to be bound by these Terms.

Important - MiluTV is a BYOL player. MiluTV is a media player. We do not provide, host, operate, curate or control any IPTV content, channel, playlist, stream, or metadata source. You are solely responsible for the playlists (M3U, Xtream Codes) and IPTV services you connect to the App, and for ensuring that your use of such content complies with all applicable laws and with the terms of your IPTV provider.

1. Definitions

App: the MiluTV application published by us on the Apple App Store, Google Play, and the Amazon Appstore, for iOS, iPadOS, tvOS, Android, Android TV, and Fire TV.

Account: the personal account a user creates to access synchronized features of the App.

Content: any audiovisual stream, playlist, metadata, or other data accessed by the user through the App via a third-party IPTV service.

Subscription: a paid plan (monthly or yearly) that unlocks premium features of the App, purchased and managed exclusively through the relevant app store.

Store: the Apple App Store, Google Play, or the Amazon Appstore, as applicable.

2. Acceptance and Modification

By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must uninstall the App and stop using it.

We may modify these Terms at any time. Material changes will be notified in the App or by email at least 30 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms.

3. Description of the Service

The App is a cross-platform media player that lets you:

We do not guarantee that every feature will be available on every device or in every country. Features available under a free tier and features reserved for Subscription holders are described in the App.

4. Account and Eligibility

Some features require you to create an Account using an email address, Apple Sign-In, or Google Sign-In. You must be at least 16 years old to create an Account. You are responsible for keeping your credentials confidential and for any activity under your Account.

You agree to provide accurate information and to update it if it changes. We may suspend or delete Accounts that contain false information or that violate these Terms.

5. User Obligations

You agree to use the App only for lawful purposes and in accordance with these Terms. In particular, you agree not to:

You are solely responsible for the legality of the IPTV services you connect to the App. We do not monitor, filter, or endorse the content accessed through such services.

6. Subscriptions, Billing and Withdrawal

6.1 Purchase and renewal

Subscriptions are purchased exclusively through your Store account. The applicable price, billing period, and renewal conditions are displayed in the App before purchase and are governed by the terms of the Store.

Unless cancelled in accordance with your Store's rules, Subscriptions renew automatically at the end of each billing period for an identical period and at the then-current price. You may cancel renewal at any time from your Store account settings, at the latest 24 hours before the end of the current period.

6.2 Price changes

We may change Subscription prices. Price increases will be communicated with at least 30 days' notice and will apply only to the next billing period; you may cancel before the new price takes effect.

6.3 Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, by starting to use a Subscription immediately after purchase you expressly request that the service begins before the end of the 14-day withdrawal period and you acknowledge that you lose your right of withdrawal once the service has been fully performed. Cancellation of a Subscription does not entitle you to a refund of amounts already paid, except where a legal warranty applies.

6.4 Refunds

All refund requests must be addressed directly to the Store through which the Subscription was purchased, in accordance with the Store's refund policy. We have no authority to issue refunds for purchases made through a Store.

7. Intellectual Property

The App, its source code, design, trademarks, logos, and all associated materials are owned by us or our licensors and are protected by French and international intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use, subject to these Terms.

We expressly object, pursuant to Article 4 of Directive (EU) 2019/790, to the use of the App, its interface, or any data produced by it for text and data mining, including the training of artificial intelligence models, unless you have obtained our prior written authorization.

We make no claim to any third-party content accessed through the App. Metadata displayed in the App (posters, synopses, cast) is provided by The Movie Database (TMDb) and remains the property of its respective rights-holders.

We process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and the French Data Protection Act. Details on the data we collect, the legal basis, retention periods, and your rights are set out in our Privacy Policy.

You may at any time delete your account and all associated data through the App's settings or by following the procedure described on the account deletion page.

10. Warranty and Liability

The App is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any defect will be corrected.

Nothing in these Terms excludes or limits liability for gross negligence, wilful misconduct, or any liability that cannot be excluded under applicable law (including the legal warranty of conformity provided by Articles L224-25-12 et seq. of the French Consumer Code).

Within the limits permitted by law, we shall not be liable for:

You may stop using the App and delete your Account at any time. We may suspend or terminate your access to the App, with reasonable notice where practicable, in the event of a material breach of these Terms, of illegal use, or of non-payment of a Subscription. Termination does not affect any rights or obligations that accrued prior to the termination date.

12. Additional Terms for the Apple App Store

The following provisions apply only if you obtained the App through the Apple App Store. In the event of any conflict with the rest of these Terms, the provisions of this section prevail for Apple App Store users.

13. Additional Terms for Google Play

The following provisions apply only if you obtained the App through Google Play.

14. Additional Terms for the Amazon Appstore

If you obtained the App through the Amazon Appstore, your use of the App is also subject to the Amazon Appstore Terms of Use. Subscriptions purchased through the Amazon Appstore are billed and managed by Amazon, and refund requests must be submitted to Amazon in accordance with its policies.

15. Governing Law and Disputes

These Terms are governed by French law. Nothing in this clause deprives consumers of the protection of the mandatory provisions of the law of their country of habitual residence.

In the event of a dispute, you are invited to contact us first at [email protected]. If no amicable solution is reached within 60 days, you may, in accordance with Articles L611-1 et seq. of the French Consumer Code, refer the dispute free of charge to the consumer mediator of our sector. You may also use the European Union's Online Dispute Resolution (ODR) platform.

Failing an amicable resolution, any dispute arising out of or in connection with these Terms shall be brought before the competent French courts, subject to any non-waivable rules on consumer jurisdiction.

16. Miscellaneous

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No waiver. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, or sale of assets.

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreement.
